State of Texas v. U.S. Department of Homeland Security

Last update: Apr 6, 2026 Filing Location: U.S. District Court for the Eastern District of Texas, Tyler Division

NILC has filed an Amicus Brief on behalf of American Families United. In this case, Texas and other states sued the federal government to stop the Keeping Families Together Parole in Place policy, which allows eligible noncitizens to apply for work authorization and adjustment of status in the U.S. without having to leave the country for processing.

Case Number: No 6:24-cv-000306

NILC represents American Families United, an advocacy organization dedicated to ensuring U.S. citizens and their noncitizen spouses can remain together in the United States without fear of separation.  Our amicus brief features the stories of families who are in danger of separation if the Keeping Families Together Parole in Place policy is prevented from going into effect.

Family unity is not only an important goal of immigration law, but it provides a significant public benefit to the U.S. by promoting the economic and social stability of families and preventing the negative health outcomes of family fragmentation.
