Public Comment on Oklahoma State Dept. of Education’s Proposed Rule

The National Immigration Law Center (NILC) respectfully submits the following written public comment concerning the State Department of Education’s Proposed Rule requiring school districts to determine and report on citizenship and immigration status.

The Proposed Rule Change to 210:10-1-5(d) (Proposed Rule) would require parents or legal guardians to provide proof of U.S. citizenship or legal immigration status at the time of school enrollment. School districts would be required to record and report the number of students for whom parents or legal guardians do not establish citizenship or legal immigration status to the Oklahoma State Department of Education.

As the attached comment explains more fully, the Proposed Rule violates the Equal Protection Clause of the Fourteenth Amendment of the United States Constitution.
