NILC Statement on Justice Stephen Breyer’s Retirement from Supreme Court

WASHINGTON — Marielena Hincapié, executive director of the National Immigration Law Center and the NILC Immigrant Justice Fund, issued the following statement on the anticipated retirement of Justice Stephen G. Breyer at the end of this Supreme Court term:

“Throughout his decades of service on the Supreme Court, Justice Stephen Breyer has regularly voted on the right side of history in decisions of great consequence to immigrant communities and our country. As a member of the Court’s five-member majority in Regents v. DHS, Justice Breyer stood strong with immigrant youth to preserve DACA, and he stood with our communities by rejecting the previous administration’s most egregious anti-immigrant attacks.

“President Biden now has an opportunity to nominate a justice who can build on Justice Breyer’s legacy and be an enduring progressive champion who will defend our fundamental constitutional rights on the Court for decades to come. As he considers who should fill this historic vacancy, President Biden must fulfill the promise he made as a candidate to nominate the first Black woman to serve on the Supreme Court.

“All of us, including the millions of immigrants who call this country home, are counting on President Biden to nominate a justice who recognizes the constitutional imperatives of racial equity, gender justice, and the right to vote in protecting our democracy.”
