Position and Background

The National Immigration Law Center (NILC) is seeking a labor/employment policy attorney to help advance a national agenda on immigrant workers’ rights that will improve the labor, civil, and due process rights of low-wage immigrant workers. This position offers a unique opportunity to work on the complex intersection of immigration and employment/labor laws, and implement multiple strategies that help immigrant workers combat discrimination and exploitation.

Over the past 30 years, NILC has earned a national reputation as a leading expert on the complex interplay between immigrants’ legal status and their rights under U.S. laws. Our policy advocacy has played a key role in protecting low-wage immigrant workers from discrimination and exploitation in the workplace, and we have provided advocates and organizers with the necessary tools to help support immigrant workers in these situations.

NILC’s impact litigation has also resulted in significant victories, including the litigation against the Department of Homeland Security to stop the agency’s proposed rule on Social Security Administration’s no-match letters. Our trainings, publications, and technical assistance reach an unusually diverse constituency of legal aid attorneys, the nonprofit community, labor, and interfaith groups, government officials, and pro bono attorneys serving low-income immigrants. NILC’s headquarters is in Los Angeles, and a branch office is in Washington, D.C.

Responsibilities

  • Will act as lead on employment and labor issues affecting low-wage immigrant workers;

  • Work with local, state, and national advocates, service providers, labor unions, and government officials to develop strategies that protect the employment rights of low-wage immigrant workers;

  • Research and write fact sheets, memos, and articles for audiences of varied backgrounds;

  • Plan and conduct trainings and conference presentations for audiences of varied backgrounds;

  • Provide technical assistance on labor and employment issues affecting immigrant workers (including anti-discrimination protections, ICE audits, SSA verification programs, the IMAGE program, the E-Verify program, and worksite raids during labor disputes) to attorneys, advocates, community and union organizers, and serve as a resource to these groups and the media;

  • Provide back-up to policy staff advocating for legislative and administrative remedies for immigrant workers; and

  • Help develop and conduct impact litigation.

Education/Training

Juris doctorate, minimum 3 years of relevant experience, plus active bar membership (preferably in California).

Qualifications

  • Mid- to senior-level attorney with at least 3 years of relevant legal and policy expertise in labor and employment law and advocacy; immigration law experience also preferred;

  • Extensive knowledge of the issues affecting low-income immigrant workers;

  • Experience working with diverse constituencies (e.g., immigrant advocates, labor unions, attorneys, grassroots organizers, etc.);

  • Experience designing and conducting trainings, and willingness to travel;

  • Some litigation skills and relevant administrative advocacy experience preferred;

  • Excellent research and analysis skills important;

  • Demonstrated ability to communicate clearly and effectively in writing and verbally; demonstrated ability to work with a team; self-motivated individual with demonstrated ability to take initiative and create an agenda for the work;

  • Experience in management and supervision of legal work preferred;

  • Strong commitment to social justice issues required;

  • Active membership in a state bar and willingness to take the California bar exam if not a member.

Salary and Benefits

Salary scale, $51,585.30 - $75,040.06, DOE. Benefits include health, dental, and vision; flexible spending account; 403(b) employer retirement plan contribution after two years.

  • Work closely with the Policy Director and staff attorneys to develop and implement NILC’s immigrant worker policy agenda.

  • Engage in administrative and legislative advocacy to protect the rights of low-wage immigrant workers.

  • Analyze Congressional and administrative proposals related to NILC’s policy priorities.

  • Draft talking points for Congressional staff and allies and action alerts for NILC’s network.

  • Conduct presentations to a wide range of audiences, including before government agencies and policymakers.

  • Work closely with the NILC’s labor/employment staff to engage state and local organizations to participate in federal advocacy.

Education/Training

Juris doctorate or master’s degree, or 3 years of relevant experience.

Qualifications

  • Knowledge of the issues affecting low-wage immigrant workers;

  • Demonstrated experience in federal advocacy required with preference for legislative and administrative advocacy or other relevant experience in Washington, D.C.

  • Strong planning and organizational skills with demonstrated ability to take initiative and create an agenda for the work;

  • Experience working with diverse constituencies (immigrant advocates, labor unions, attorneys, grassroots organizers, etc);

  • Excellent research and analytical skills;

  • Demonstrated ability to communicate clearly and effectively in writing and verbally; demonstrated ability to work with a team; and

  • Contact with Congressional and administrative staff strongly preferred.

NILC seeks fellowship applicants to work in our DC office on immigration reform policy issues benefiting low-income immigrants in one or more of NILC’s priority areas:  immigration law, including due process and access to lawful status; immigrant workers’ rights and employment issues; and access to health care and public benefits.  NILC will work closely with the selected applicants to ensure that the volunteer’s skills are matched with a project that is integral to NILC’s priorities and meets a core need in the immigrant community.  For more information on NILC, see www.nilc.org.

HISTORY

    Established in 1979, the National Immigration Law Center is dedicated to protecting and promoting the rights of low-income immigrants and their families. Over the past 30 years, NILC has earned a national reputation as a leading expert on immigration, public benefits, and employment law affecting immigrants and refugees. Our extensive knowledge of the complex interplay between immigrants’ legal status and their rights under U.S. law is an essential resource for legal aid programs, private legal practitioners, community groups, labor unions protecting workers’ rights, and social service agencies across the country.

WHAT WE DO

    Policy Analysis & Advocacy.  With a strong presence in Washington, DC, and Los Angeles, CA, NILC develops in-depth analyses of proposed legislative and regulatory changes that advocates and policymakers rely on for accurate, insightful information. NILC disseminates timely updates and alerts, convenes ongoing workshops of national advocacy organizations and community agencies, and coordinates strategic responses to policy changes.

    Impact Litigation.  Over the years, NILC’s attorneys have won significant legal victories, including several nationwide injunctions that protect immigrants’ access to the courts and their right to due process. As a result of NILC cases, immigrants in immigration detention must be afforded access to an attorney and children in immigration custody must be put in contact with an adult relative or legal service agency who can help them.

INTERNSHIPS

    NILC provides a rich environment for law student interns to learn about the immigrant rights movement and to work alongside attorneys and policy analysts involved in national policy analysis, impact litigation, and lobbying.

    Our primary areas of focus are:

  1. Immigration law, including due process and access to lawful status,

  2. Immigrant workers’ rights as they relate to full employment, and

  3. Access to health care and other public benefits.
