August 15, 2007, and October 28, 2008, relating to
procedures that employers may take to acquire a safe harbor

(10/23/08).
"The final rule does not make any substantive changes from
the August 2007 Final Rule or the Supplemental Proposed
Rule." 73 FR at 63861. Implementation of the Aug.
2007 rule was preliminarily enjoined by the U.S. District
Court for the Northern District of California on Oct. 10,
2007 (see below). The
injunction remains in effect pending further court
proceedings.

Supplemental Proposed "No-Match"
Letter Rule,
73 FR 15944-55 (Mar. 26, 2008).
DHS has
published
a proposed rule that purports to clarify its
Aug. 2007 final rule regarding an employer's legal
obligations upon receiving a "no-match" letter from the Social Security Administration. Implementation of the Aug. 2007
rule was preliminarily enjoined by the U.S.
District Court for the Northern District of California on
Oct. 10, 2007 (see below). Shortly after the decision, DHS asked the
court to suspend the litigation while it revised the rule so
it would pass legal muster and address the concerns raised
by the court.
Now, DHS is proposing to reissue the rule "without change"
